SecurEcommerce App Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the SecurEcommerce application ("App") through the Shopify App Store, you ("User," "Merchant," or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

2. Description of Service

SecurEcommerce is a security monitoring application that provides:

• Email security monitoring (DMARC, SPF, DNS records)
• Data breach monitoring via third-party APIs
• Domain typosquatting detection
• SSL certificate monitoring
• Store clone detection
• Security dashboard and reporting

IMPORTANT: This App provides monitoring and alerting services only. It does NOT provide active security protection, prevention, or remediation services.

3. Service Limitations and Disclaimers

3.1 Monitoring vs. Protection

• The App provides monitoring and detection services only
• The App does NOT prevent, block, or stop security threats
• The App does NOT provide real-time protection or active security measures
• Detection and alerting may have delays and may not be immediate
• The App may not detect all security threats or vulnerabilities

3.2 No Guarantee of Security

• The App does not guarantee the security of your Shopify store
• The App does not guarantee prevention of security incidents
• The App does not guarantee accurate or complete threat detection
• Users remain solely responsible for implementing actual security measures
• Users are responsible for taking action on alerts and recommendations

4. User Responsibilities

4.1 Security Responsibility

• You remain solely responsible for the security of your Shopify store
• You are responsible for implementing appropriate security measures
• You must evaluate and act upon alerts and recommendations provided by the App
• You are responsible for maintaining secure passwords, access controls, and store configurations

4.2 Monitoring Configuration

• You are responsible for configuring monitoring settings appropriately
• You must provide accurate contact information for alerts
• You are responsible for regularly checking the App dashboard and alerts

5. Data Access and Processing

5.1 Shopify Data Access

By installing the App, you grant SecurEcommerce permission to:

• Access your Shopify store data as specified in the App permissions
• Monitor your store's email domains and DNS configurations
• Access store configuration data for security analysis
• Store and process this data for monitoring purposes

5.2 Third-Party Integrations

The App uses third-party services including:

• HaveIBeenPwned API for breach monitoring
• DNS analysis services
• Domain threat assessment services
• SSL certificate monitoring services

5.3 Data Retention

• Monitoring data is retained while the App is installed
• All data is permanently deleted within 30 days of App uninstallation
• Historical security data may be retained for up to 2 years for analysis

6. Limitation of Liability

6.1 No Liability for Security Incidents

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECURECOMMERCE SHALL NOT BE LIABLE FOR:

• Any security breaches, data breaches, or security incidents affecting your store
• Any damages resulting from missed, delayed, or inaccurate threat detection
• Any losses resulting from reliance on App monitoring or alerts
• Any damages from third-party security threats or attacks
• Any business interruption, lost profits, or consequential damages

6.2 Service Limitations

SECURECOMMERCE IS NOT LIABLE FOR:

• Service downtime, interruptions, or availability issues
• Delays in threat detection or alert delivery
• Third-party API failures or limitations
• False positives or false negatives in threat detection
• Any actions taken or not taken based on App recommendations

6.3 Maximum Liability

In no event shall SecurEcommerce's total liability exceed the amount paid by you for the App in the 12 months preceding the claim.

7. Disclaimers

7.1 "AS IS" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING:

• No warranty of uninterrupted or error-free operation
• No warranty of complete or accurate threat detection
• No warranty of prevention of security incidents
• No warranty of compatibility with all Shopify configurations

7.2 Third-Party Services

We disclaim all liability for third-party services, APIs, and integrations used by the App.

8. Indemnification

You agree to indemnify, defend, and hold harmless SecurEcommerce, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your breach of these Terms
• Security incidents affecting your store
• Claims that your use of the App violated any third-party rights

9. Service Availability

9.1 Best Effort Service

• The App is provided on a "best effort" basis
• We do not guarantee 100% uptime or availability
• Maintenance windows may cause temporary service interruptions
• Third-party API limitations may affect service functionality

9.2 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue the App at any time
• Change monitoring frequencies or capabilities
• Update third-party integrations or remove features
• Modify these Terms with appropriate notice

10. Termination

10.1 Termination by User

You may terminate your use of the App by uninstalling it from your Shopify store.

10.2 Termination by SecurEcommerce

We may terminate your access to the App for:

• Violation of these Terms
• Abuse of the service
• Non-payment of fees (for paid plans)
• At our discretion with reasonable notice

10.3 Effect of Termination

Upon termination:

• Your access to the App will cease immediately
• All monitoring services will stop
• Your data will be deleted according to our retention policy

11. Compliance and Legal

11.1 Shopify Compliance

This App complies with:

• Shopify Partner Program Agreement
• Shopify App Store Review Guidelines
• Shopify API Terms of Service

11.2 Data Protection

The App processes data in accordance with applicable data protection laws and our Privacy Policy.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of the jurisdiction where SecurEcommerce operates.

12.2 Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with commercial arbitration rules.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

• Email notification to registered users
• In-app notifications
• Updates to this document

Continued use of the App after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
